The Washington Post has
an editorial that is a reasonable synthesis of Dahlia Lithwick's analysis from yesterday, and my remarks of Jan 21 on Judge Bork's WaPo column. The courts are not the best place to be figuring these things out, but as long as the administration fails to engage Congress on them, there's not much alternative.
